   Ordering a Spa Tour – the Customer’s indication in a web form on the Contractor’s website of one of the Spa Tour programs offered by the Contractor for the purpose of purchasing the services included in it on the date and time specified by the Customer.

General provisions. Subject of the agreement.

1. An order for a Spa tour placed on the Contractor’s website means that the Customer agrees with all the terms of the Offer.

   The Administration of the Contractor's website has the right to make changes to the Offer without notifying the Customer. In this case, the legal relations of the parties to the Agreement in relation to each Spa Tour Order are governed by the version of the Offer that was published on the Contractor’s website at the time of placing this Spa Tour Order.

   The validity period of the Offer is unlimited, unless otherwise indicated on the Contractor's website.

   The Agreement is considered concluded at the moment the Contractor sends confirmation of the possibility of providing the Services on the requested date to the Customer’s email address specified when Ordering the Spa Tour.

   The Contractor has the right, before the start of the provision of Services, to invite the Customer to sign a contract for the provision of paid services included in the Spa tour in writing.

   If the Services contain medical services, the condition for their provision is that the Customer provides written informed voluntary consent to medical intervention.

Rights and obligations of the parties.

1. The Contractor has the right to engage third parties to provide Services, while remaining responsible for the proper execution of the Agreement. Moreover, if necessary, the Contractor involves the Customer in negotiations with such persons.

   The Contractor has the right to refuse to fulfill the Order of a Spa Tour to the Customer if it is not technically possible to provide them, of which the Customer is notified in accordance with clause 2.4 of the Agreement.

   Before providing the Services, the Contractor is obliged to provide the Customer with all the necessary information about all the essential characteristics of the Services. This obligation is considered fulfilled upon publication of all characteristics of Spa tours on the Contractor’s website.

   The Customer is obliged to accept the Services provided and sign the Certificate of Services Rendered. The Contractor has the right to send a Certificate of Services Rendered for signing to the postal address or email address specified by the Customer when Ordering the Spa Tour. Such an act will be considered signed if, within 10 (ten) days from the date of its sending, the Customer does not send motivated objections to the Contractor regarding the quality and quantity of the Services provided.

   The Customer has the right to exercise control and supervision over the progress and quality of the provision of Services without interfering in the business activities of the Contractor.

   The Contractor has the right to process personal data of the Customer and persons whose legal representative he is, in whose interests the Contract is concluded, to the extent necessary for the conclusion and execution of the Contract, as well as to transfer it to persons engaged by the Contractor for the direct provision of Services, to the extent necessary for these persons to provision of Services.

Cost of Services and payment procedure.

1. The cost of Services for each Spa Tour program is determined on the Contractor's website; VAT is not assessed (a simplified taxation system is applied).

   Unless otherwise determined by the Parties in additional agreements, payment for Services is carried out on the basis of 100% prepayment before the start of the provision of Services to the Contractor's cash desk.

   If the Parties agree to change any characteristics of the Services, resulting in an increase in their cost, the Customer undertakes to sign the corresponding additional agreement to the Agreement and pay the cost of the Services within 5 (five) banking days from the date of signing the said agreement or from the date of issue by the Contractor adjusting account.

Responsibility of the Parties.

1. For violation by the Customer of the terms of payment for Services, the Contractor has the right to demand payment of a penalty at the rate of 0.5% of the cost of the Spa tour for each day of delay.

   The Customer undertakes to fully compensate the Contractor for losses caused to him. The actual damage caused by the Customer is recorded in the Damage Report. To do this, the Contractor sends the Customer a notice of the need to arrive to draw up and sign such a Certificate within a reasonable time. The Contractor has the right to sign the Damage Report unilaterally if the Customer's representative does not appear on the appointed date for its preparation and does not request to postpone the time of its preparation. In this case, the Damage Certificate signed by the Contractor unilaterally will be binding on the Parties.

Amendment and termination of the Agreement.

1. The Contractor has the right to unilaterally refuse to fulfill the obligations assumed in accordance with the signed Appendix by sending a written notice to the Customer about this

      in case of failure by the Customer to fulfill the obligation to pre-pay for the Services.

   The Customer has the right to unilaterally refuse the Services by sending the Customer a corresponding written notice. In this case, the Customer is obliged to pay the Contractor the actual expenses incurred by him.

   Any changes and additions to the Agreement are valid provided they are made in writing. The written form is considered to be observed when sending documents by e-mail. For these purposes, the e-mail address of the Parties must be indicated in the web form filled out when Ordering a Spa Tour, or in the text of the Agreement (appendices, additional agreements thereto); otherwise, the proper email address is considered to be the address through which the Parties carried out undisputed transactions in pursuance of the Agreement.

   Changing any characteristics of the Services after the conclusion of the Agreement is possible by mutual agreement of the Parties.

   1. In cases where such changes do not entail an increase in the cost of the Services and the agreement of the Parties regarding the changes is evident from their correspondence, the signing of additional agreements to the Agreement is not mandatory.
